Usage Conditions

    • At KMEW, we have established "Usage Conditions" for "KMEW websites (the website of KMEW and the websites of each headquarters)". Usage of the KMEW websites shall be deemed to indicate agreement to these Usage Conditions.

    Note that KMEW reserves the right to amend these Usage Conditions. The amended Usage Conditions will be posted here, so please check the latest version as appropriate. Usage of the KMEW websites shall be deemed to indicate agreement to the amended Usage Conditions as well. In the event that the customer violates any of these Usage Conditions, they may be required to follow the instructions of KMEW to make amends.

    1. Definitions

    • Herein, "contents" shall have the meaning of content (including, but not limited to, prose text, slogans, logos, trademarks, trade names, photographs, illustrations, graphs and tables, drawings, movies, videos, still images, music, other audio, software, computer programmes, databases, data, etc.) posted on the KMEW websites.
    • Herein, "the customer's computer" shall have the meaning of the single computer presently used by the customer to view the KMEW websites.

    2. Scope of usability

    2-1. The customer shall have the ability to use the customer's computer to view the contents provided by KMEW or print the contents out for personal use. Please note that a certain portion of the contents cannot be printed out.

    2-2. The customer shall have the ability to use the customer's computer to download for personal use only the contents provided by KMEW that are downloadable. Contents may have individual usage conditions indicated. The customer is requested to abide by the said individual usage conditions.

    2-3. The customer shall, with regard the KMEW websites and contents, be prohibited from usage not specified in the above 2-1 and 2-2 or any other action (including, but not limited to, reproduction, alteration, analysis, transmission, transfer, lending, authorisation of use, export, use for sales or other profit-seeking activities, etc.), except in the event that they have received advance authorisation from KMEW.

3. Forbidden actions

It is forbidden to perform the following actions when using the KMEW websites.

  • Actions that cause, or that may cause, harm, financial or otherwise, to KMEW or any third party
  • Actions that constitute, or that may constitute, slander or libel against the products or services of KMEW
  • Actions that constitute, or that may constitute, slander or libel against the directors or employees of KMEW
  • Actions that harm, or that may harm, the public trust or dignity of KMEW, by such means as violating public standards or morals
  • Actions that constitute, or that may constitute, criminal activity or actions that lead to criminal activity
  • Actions that violate, or that may violate, laws, ordinances, or regulations
  • Actions that cause, or that may cause, misidentification as being in a partnership or cooperative relationship with KMEW, or misidentification of KMEW as recognising, guaranteeing, endorsing, or recommending any linked website
  • Actions that link in a manner that impairs the clarity of the KMEW websites, such as by means of frame links
  • Actions that are otherwise deemed by KMEW to be inappropriate and whose cessation was requested by KMEW

4. Links

Links to the KMEW websites (including printing the URLs of the KMEW websites in publications such as books and magazines) shall be permitted, assuming that the condition of adhering to all Usage Conditions of the KMEW websites is met. This shall be the case irrespective of whether the linking is performed via the Internet or an intranet, and whether it is done for profit or non-profit purposes. Among the Usage Conditions, it is especially requested that the party engaging in the linking familiarise themselves with, and abide by, 3. Forbidden actions and the following stipulations. It is unnecessary to contact KMEW when linking. (Hereinafter, both third-party websites to which KMEW websites link and third-party websites that link to the KMEW websites shall be collectively referred to as "link sites".)

Link sites shall be managed and operated on their own managers' responsibility, and are not under the management of KMEW. The customer is requested to abide by the usage conditions of each link site when using them. KMEW is not responsible for the contents of link sites or any damages, complaints, or any other claims caused by the use of link sites, including damages from third parties.

The fact of KMEW websites linking to, or being linked to from, link sites does not constitute KMEW recognising, guaranteeing, endorsing, or recommending the use of the link sites, or products, services, companies, etc. posted on the link sites. It also does not mean that there exists any connection or other kind of special relationship between KMEW and the link sites.

Compliance items

4-1. The information and URLs of the KMEW websites are not guaranteed to be permanent, and may, without notice, be changed, cancelled, or deleted. Link site maintenance, including changes to URLs, is performed under the authority of the said link sites' managers. KMEW accepts no responsibility for any harm to the link sites or their managers, viewers, or any third parties, as a result of linking being performed between the said link sites and the KMEW websites.

4-2. It is requested that link buttons use either the company name of "KMEW" written in normal text or a banner logo provided by KMEW. If linking with a banner logo, make sure to use one of the banner logos below. KMEW reserves the trademarks and all other intellectual property rights relating to these banner logos. It is forbidden to make alterations, changes, amendments, etc. when using these banner logos.

4-3. It is requested that, when linking to KMEW websites, the name of the linked page be indicated correctly based on the linked page's "Title" or similar.

4-4. KMEW strictly prohibits linking from websites that constitute the following:
• websites containing content that constitutes slander or libel against KMEW or against the directors or employees of KMEW;
• websites containing content that constitutes slander or libel against KMEW's products or services;
• websites containing content that harms the public trust or dignity of KMEW, by such means as violating public standards or morals;
• websites containing content that constitutes, or that may constitute, criminal activity or actions that lead to criminal activity; and
• websites providing information that violates, or that may violate, laws, ordinances, or regulations.

4-5. In the event that the linking website is determined to be in violation of any of the above stipulations, or that KMEW has requested the deletion of the link(s), compliance shall be obligatory.

5. Changes (etc.) of the KMEW websites and contents

Please note that changes to or deletion of the KMEW websites and/or contents may be performed without prior notice.

6. Opinions (etc.) regarding KMEW

KMEW welcomes opinions and queries from customers. However, it is requested that the customer not send trade secrets or proprietary information of customers or third parties, the planning of new products, the naming of new products, etc., as well as other business proposals, materials, ideas, etc. (hereinafter referred to as "proposals, etc."), unless specifically requested by KMEW. Even if proposals, etc. are received, KMEW shall bear no responsibility (including, but not limited to, responsibility to adopt, make payment, or guarantee confidentiality) relating to the said proposals, etc. The customer shall be deemed to have waived all rights (including, but not limited to, trade secret rights, copyrights, and industrial property rights) related to the said proposals, etc. In the event that KMEW does specifically request proposals, etc., application guidelines shall apply.

7. Limitation of liability

7-1. During usage of the KMEW websites or contents, for any of a variety of reasons, garbling of text, missing data, errors, interruptions, or other failures can occur. KMEW shall bear no responsibility for such problems or for any damages incurred by the customer (including, but not limited to, direct damage, indirect damage, lost profits) due to use or inaccessibility of the KMEW websites or contents.

7-2. KMEW shall take great care regarding the operation of the KMEW websites, but does not provide any manner of legal guarantee of the accuracy or efficacy of the contents, nor accept legal liability or responsibility therefor.

8. Product images

Colours displayed in product images as they appear on the customer's screen may differ from the actual products. Please bear this in mind.
